Badlapur sexual assault trial:The Bombay Supreme Court Wednesday suspended to investigate the Maharashtra Police over the custodial death of Badlapur sexual assault suspect Akshay Shinde, stating that there was evidence of unjustified play and an independent investigation was required into the incident.
A division bench comprised of justices Revati Mohite Dere and Prithviraj Chavan stated that if it determines that the investigation isn’t running as it should, it could be compelled to issue appropriate orders.
A judge from the Bombay high court in Bombay confirmed that the inquiry regarding the demise of accused Badlapursexual attack suspects should be conducted in a fair and fair manner.
The court also noted that the shoot-out with Akshay Shinde might be preventedasking why the police didn’t try to take him down first.
“Why was the accused shot in head directly and not in legs or arms first,” the Bombay high court asked.
“The moment when he pulled the trigger, the others could quickly dominated him. He wasn’t a big muscled or strong person. This is a difficult thing to accept. It is not an incident,” Justice Prithviraj Chavan stated.
Akshay Shinde’s dad Anna Shinde has in a petition to Bombay high courton Tuesday with the help of lawyer Amit Katranvare, claimed it was his son’s death during a fictitious incident. He also demanded the creation of a Special Investigation Team (SIT) to look into the matter.
In the course of this hearing, top court informed an official prosecutor a revolver cannot be easily unlocked by a man who is physically weak. “It is not very easy,” it stated.
